Passing grade due to age

I was sent the link to his forum from a friend & told there were some members who may be able to help me with this.

 

My son is 14yo & has Tourette Syndrome, ADHD, & Bipolar Disorder. His teacher told me the other day that, despite his failing grades, he will likely be passed into 9th grade next year because legally they cannot hold him back if that would mean he would be the oldest student in the middle school. I don't understand this "law". She said it is in the IDEA, but I have yet to find it. If anyone here has any information about this I welcome it. Also, if there are any possible ways I can fight it to have him held back if needed. I am in Michigan if that helps any.

sorry no replies yet....our Tourette Forum here is very active whereas this on for LD has always been slow

 

you may want to ask this on the TS board as well

 

I am in Florida so cant really answer anything related to the Michigan school system
